However the proposed amendments do seem to embrace this concept …”After the hearing, the rule was partially corrected and adopted at about the same time.I attempted to obtain 20 legislators to object to the rule for the reason expressed by the legislative staff attorney.Legislators were told that it was too late to object to the rule because it had already been adopted. Objections were only allowed on proposed rules.The Department of Revenue published guidelines in the form of answers to frequently asked questions. Copies of these guidelines were frequently provided as reason for assessing taxes on 450 National Guard tax returns.The Department of Revenue published: “…National Guard AGR members are not tax exempt…” This is inconsistent with legislation, current administrative rule, and final determination in Office of Dispute Resolution Cause No. 12-143-IT.MCA 15-30-2117 (b) (i) The salary received by residents of Montana for active duty in the national guard is exempt from state income tax.      (ii) For the purposes of this subsection (2)(b), "active duty" means duty performed under an order issued to a national guard member pursuant to:      (A) Title 10, U.S.C.; or      (B) Title 32, U.S.C., for a homeland defense activity, as defined in 32 U.S.C. 901, or a contingency operation, as defined in 10 U.S.C. 101, and the person was a member of a unit engaged in a homeland defense activity or contingency operation. See www.mtnationalguardtax.com for more information.
